BELOW ARE THE TERMS AND CONDITIONS FOR COMMISSIONING A CUSTOM PAINTING
The purpose of this contract is to ensure clarity and transparency throughout the commission process.
Please be mindful that submitting a proposal does not guarantee that your application will be successful.
WHO “OWNS” THE ARTWORK?
Once delivered, you own the original piece and reserve the right to display the artwork in your home.
The artist retains all copyright and reproduction rights to any and all artwork produced. This includes and is not limited to the means of resale through prints and merchandise. The purchase of partial or full rights to the artwork is firmly unattainable and is not subject to negotiation.
PAYMENT, HOW DOES IT WORK?
Payment options include PayPal and invoice. Please note that neither the painting nor the initial concept design will commence without a 50% (non-refundable) deposit. Once your artwork is complete, the remaining 50% will be invoiced with a seven day due date, and payment is expected to be prompt. The painting will hang tight in the studio until the payment has cleared! If the payment has not been received within 30 days of delivery to your inbox, the artwork will be re-sold with no refund to you. Exceptions are made under extreme circumstances and that decision is solely reserved to be made by the artist.
SHIPPING THE ARTWORK, WILL YOU DELIVER TO MY COUNTRY?
I’ve got you covered for shipping fees (no matter the destination) and it will be delivered directly to your door via courier 🙌 The artwork will be sent with a certificate of authenticity, a gift from the studio, and a warranty for shipment. Warranty does not extend beyond the confines of delivery and it is advised that you insure your artwork independently once it has arrived.
The client is allocated 2 adjustments within the agreed-upon price. If further adjustments are requested, a fee of $700 per adjustment will be added to the final sum.
You will be provided with a digital mock-up of the piece for your approval. Note that the mock-up is a concept for me to draw upon within the painting process. The mock-up will not be identical to the finished piece, but that’s where the beauty is! Intuitive mark-making is an important aspect of my creative process and thus cannot be designed in pre-production.
ACCEPTING MY PROPOSAL, I HAVEN’T HEARD BACK FROM YOU?
If successful, you will be contacted personally through firstname.lastname@example.org. Please be mindful that I receive many commission requests and understandably, cannot respond to everyone. I know this may be disappointing, but I can only fit a select few into my schedule each quarter!
Unfortunately, If you have not received word from me within 14 days of submitting your proposal please consider your application unsuccessful. This is non-negotiable and harassment will not be tolerated.
Offering commissions is a luxurious experience and I will endeavor to maintain a joyous and welcoming environment throughout the entire process! Below are the general terms and conditions regarding etiquette between us to ensure clarity and safety.
Timely responses to emails and invoices are encouraged.
Harassment, bullying, and discrimination will not be tolerated under any circumstances. In extreme circumstances, the artist retains the right to terminate the commission without refund.
Requesting additional adjustments and alterations beyond the agreed-upon concept design is prohibited unless express permission is granted as above with an additional fee.
Tight deadlines will be refused.
Frequent emails intended to speed up the production time are not welcomed and may delay the completion of the artwork. Stressed artists don’t create good paintings!
SUBJECT MATTER THAT WHAT WILL BE DECLINED
Portraits of children
Subject matter violating community guidelines outlined by TikTok and Instagram
Client’s family members or pets
Drastic stylistic alterations
Once your commission has been accepted, the price will be locked into the agreed-upon sum unless further adjustments are required. The artist retains the right to increase the price of any and all future commissions.
The raising of artwork prices is an industry-standard that will increase the value of your original over time.
As commissioning and artwork are customized and take a significant amount of preparation, understandably the custom pieces are priced higher than some of the available paintings listed in the online gallery.
RETURNS AND LIABILITY
All original purchases including commissions are final. As your custom piece is personalized, comes with a special gift just for you and I personally pay a generous amount to ship them via courier. Additionally, as the commissioning process is often lengthy and disruptive to my natural creative flow, the 50% deposit secures your place in the commission calendar and pays for a portion of my time. The 50% deposit is strictly non-refundable.
